TERMS AND CONDITIONS

 

  1. Noise
    1. Keep the noise level within the tolerance of others in the Premises and reduce if requested to do so
    2. No noise shall be caused between 11PM and 6AM
  2. Avoid the following-
    1. Abusive or foul language
    2. Harassment in any form to anybody present within the Premises
    3. Fight/quarrel with the other occupants of the building/instigating the other occupants to fight
    4. Smoking and use of alcohol except in designated areas
    5. Drugs, explosives & weapons in the whole Premises
    6. Conducting/carry out any kind of business
    7. Alterations to the Premises, any electrical or furnishings of the Premises
  3. The Sub Lessee shall not cause any damage to the Premises or Building. In case of any such damages caused by the Sub Lessee to the Premises or Building, the Sub Lessee shall be liable to pay the cost of repairs/replacement due to such damage. If the Sub Lessee fails to pay the cost, the Sub Lessor shall deduct such cost from the Deposit and claim for the balance cost of the repairs from the Sub Lessee.
  4. The Sub Lessor shall carry out the repairs of the below items and shall be entitled for reimbursement of the repairs cost from the Sub Lessee, if any damage caused by the Sub Lessee in the Premises/Building including but not limited to the following:
    1. Any damages to the electrical items
    2. Physical damages to the electronics items
    3. Physical damages caused to any of the furniture or furnishings
    4. Damages to bath fittings
    5. Damages to any of the kitchen appliances
    6. Replacement of any part for any of the above mentioned appliances
    7. Damages to any of the Items (Sports/Gym Equipment, Games, Electronics, Furniture, Walls and artwork) in the common spaces
  5. Cleanliness
    1. Kindly keep the Premises clean and tidy and ensure your belongings are kept within your designated area
    2. Keep the common area clean after you for others to enjoy the common facilities of the Premises
  6. Housekeeping would be provided to the Sub-Lessee by the Sub-lessor. Further on request from the Sub Lessee, the Sub Lessor may provide Housekeeping facility subject to availability. The Sub Lessee shall pay an amount of Rs. 250/- per request. The Housekeeping services will be provided on Monday to Saturday (a week). Scope of Housekeeping shall be as follows:
    1. Dishwashing (6 days a week)
    2. Cleaning the bathroom (3 times a week)
    3. Sweeping and mopping the floor in the hall, bedroom, kitchenette and balconies (6 days a week)
    4. Clearing the trash (6 days a week)
    5. Windows and windowpanes (twice a month)
    6. Dusting the furniture (6 days a week)
    7. It is clarified that Pet’s cleanliness is not part of the House Keeping
  7. Pet Policy
    1. If the Sub Lessee occupies the whole flat/apartment, the Sub Lessee shall be entitled to keep pets in the flat/apartment/Premises (not applicable if the flat/apartment is shared with other occupants). The Sub Lessee shall keep the pets in the Premises under the condition that the Pets shall not be allowed in the common areas of the building or other apartment of the building and no littering on the common areas of the building, hallways, corridors or any other premises in the building.
    2. In the event of breach of any of the condition of Pet Policy, the Sub Lessee shall pay an amount of Rs.1,000/- as penalty per breach and if the Sub Lessee continues to breach the Pet Policy for more than three (3) times, the Sub Lessor shall be entitled to terminate the Agreement by giving seven (7) days prior written notice.
    3. The Sub Lessee shall be responsible for all the acts of the Pets and the Sub Lessee shall indemnify Sub Lessor for any loss or damage that may occur due to the act of the Pets.
    4. In the event, the Sub Lessee wishes to have his/her Pet/s in the Premises, the Sub Lessee shall ensure to provide a copy of the Pet’s medical records. Cleaning of the Pet inside or outside the Premises is the responsibility of the Sub Lessee provided the same shall not cause any disturbance to any other occupants.
  8. If Sub Lessees who are of opposite genders and not married stay in the Premises the same shall be at Sub Lessee’s own risk and the Sub Lessees shall indemnify the Sub Lessor for all the consequences including but not limited to any action taken by any third party. In this regard, it is specifically agreed by the Sub Lessee that in the event any action is taken by the local authorities/police against the Sub Lessee or the co-occupants, the Sub Lessee shall be solely liable for the same to the total exclusion of the Sub Lessor.
  9. Guests
    1. It shall be the responsibility of the Sub Lessee to keep the management informed about any guests who are staying at StayAbode. An additional charge of Rs. 2000 per night per guest shall be levied on the Sub Lessee for admitting a guest without receiving prior approval from the management.
    2. If Sub Lessee invites guest to the accommodation, the Sub Lessee shall indemnify the Sub Lessor for any of the consequences of such stay in the Premises.
    3. Day visits are restricted only till 8 PM for all guests.
    4. Overnight stay must be informed to the manager within 8 PM.
    5. The Sub Lessee is fully responsible for the actions of their guests.
    6. The guest should not disturb other residents during their stay in StayAbode.
  10. Theft & Damage Policy
    1. Personal Belongings
      1. The tenant shall be responsible for his/her belongings in the Scheduled Premise and neither StayAbode nor it’s vendors shall not be held liable/ responsible for the same.
      2. For general maintenance and/or showing the scheduled premises to any prospective tenants, StayAbode shall keep an extra key of the scheduled premises. It is hereby advised to all the tenants to keep their valuables locked inside the cupboards and not to leave them unattended.
    2. Home Furnishing
      1. In the case of theft/loss and damage of any furnishing or appliance or furniture in the house , all the tenants staying at the scheduled premises at that point of time shall be held responsible.
      2. A reasonable sum shall be deducted from security deposit of tenants towards compensation of the loss/ theft and damage or an amount as mentioned in cancellation & refund policy. In case the recovery amount exceeds the security deposit, the tenants shall be liable to pay the amount.
      3. For general maintenance & showing houses to other tenants, Stayabode's employees or its affiliate agents may keep a copy of the keys of your house. We advise you to keep your valuables locked inside the cupboards & never leave them unattended in open places.
      4. We shall not be responsible for any theft or accidental damage to your valuables in case of an untoward incident.
  11. DEPOSIT PAYMENT & REFUND POLICY
    1. Deposit Payment Terms
      1. Tenant needs to pay three months of rent as security deposit.
      2. Tenant is required to pay a part of the security deposit, referred as the token deposit, at the time of booking.
      3. The security deposit paid is mentioned in the rental agreement.
      4. Security / token deposit can be paid either by cheque or online.
      5. In the case where a tenant chooses to make an internal transfer or upgrade his/her current booking type, the difference in the amount of security deposit will be expected to be paid by the tenant before him/her making the actual transfer. In case the new rent is lower, the difference in security deposit is adjusted against the following month’s rent.
    2. REFUND ON CANCELLATION
      1. Cancellation before SubLease start date
        1. If Tenant cancels before sub-lease start date, the token deposit will not be refunded.
        2. If StayAbode cancels before sub-lease start date, the token deposit will be entirely refunded.
      2. Cancellation after License Start Date
        1. If booking is cancelled within 3 days of move in, refund would be processed after deducting the rent for the number of days from license start date + move-out charges(INR 2500).
        2. If booking is cancelled after 3 days of move in, then lock in breach charges, notice period shortfall charges, renovation charges etc as per the policies will be applicable.
    3. Refund on move-out
      1. Cancellations are allowed only up to 3 days of move in and anything after that would be considered a move out.
      2. The security deposit shall be refunded, after deduction if any as per StayAbode’s policies, within 15 bank working days from the day of move-out.
      3. If the tenant decides to move out before completion of rental contract period with StayAbode, one month's rent for contract breach will be charged.
      4. Tenant has to serve 30 days of notice period without exception, any shortfall in notice period will be charged pro rata based on the shortfall in the number of days from the 30 day notice period.
      5. Any unpaid rent, utility payments will be deducted from the security deposit.
      6. A charge of INR 2500 will be deducted towards cleaning of the room, linen change etc. on opting to move out. This is a fixed charge which every tenant bears upon his/her exit.
      7. Tenant has to pay for damages, on actuals, in case there’s some damage to the property or it’s belongings.
    4. Refund Mode
      1. All refund shall be processed via cheque or online transfer.
    5. Refund Timeline
      1. If the booking is made online, it shall take up to 15 bank working days to process the refund. A deposit refund statement would be sent to the tenant with a breakdown of deductions, if any.
